Does upper management in a major retail chain have the right to search female associates purses?
I work for a MAJOR retail chain who approximately two weeks ago stopped overnight female associates,with purses and asked to search them at the front.Now thereis a detector at the front and it did'nt go off.We,as associates are not allowed to ask a suspected shoplifter to open their purses.Only law enforcement can.They,management,have came up with some bull story that store policy states they have a right to search purchases and packages.How is a purse considered a package?The overnight shift has been singled out only for this.I know for a fact no other shift has been stopped at the front exits.The bad part is a customer service manager on the 2nd shift was taken out in handcuffs last week for stealing money off gift cards.But our shift has been searched and harrassed.Yes,these females let them see in their purses but they had nothing to hide but were terribly humilated.They were and still are even checking lunch boxes.Can they get away with this?are our rights being violated?
No. You must have the option to quit. An employer can make searches a condition of employment and if you agree to it by continuing to work, your rights are not violated. The fourth amendment concerning illegal search and seizure applies to governments, not to the private sector. If you don't like it, you have options. You can tolerate it. You can quit. You can negotiate your own contract of employment. You can unionize and negotiate a contract collectively.
